Farmer jailed five years for supporting IS terror group

A farmer was jailed five years by the Kuala Lumpur High Court for supporting Islamic State (IS) terror group by an oath of allegiance.

The offence was committed at Blok A, Perumahan Awam 2, Chenderiang, Batang Padang, Perak, between March 25, 2016, and June 17, 2016.

Judicial Commissioner Ab Karim Ab Rahman sentenced Zairosfitri Jainuddin Azhar after he admitted to the charge and ordered for Zairosfitri to serve his sentence from the day of his arrest which was on July 15, last year.

The charge was under Section 130J (1)(a) of the Penal Code which carries a life sentence or imprisonment of not more than 30 years, and liable to forfeiture of any asset used or intended to be used in the commission of the offence.

In his judgment, JC Ab Karim said the accused certainly understood the content of the oath of allegiance, adding that the offence was serious.

“Considering that you are still young and may hopefully serve the country, the court will give you a punishment for you and society to learn and help eliminate this group,” said JC Ab Karim.

In mitigation, Zairosfitri’s counsel Ahmad Zaharil Muhayar said that his client could easily have been influenced by elements on the Internet and his involvement was minimal.

The counsel pointed out that there was no serious offence committed by his client as he only listened out of curiosity to the group chat, adding that his client has repented and promised not to repeat the offence in future.

Deputy public prosecutor Mohamad Mustaffa P Kunyalam appeared for the prosecution.

Based on the statement of facts, Zairosfitri first joined the “Gagak Hitam” chat group which has 66 members through the Telegram application using a telephone line registered under his name and used ‘Zairos N Jack’ as his identity with a profile picture of a masked and bearded man, on March 25 last year.

Investigations revealed, he made 41 comments in the group between March 25 and June 16, 2016, which showed he knew that the group was set up to support IS agenda and struggle.

Zairosfitri made the oath of allegiance to IS terror group at 12.33am on March 29, 2016.
