Did Tony Pua commit a contempt of the Parliament?

DAP’s Petaling Jaya Utara MP Tony Pua has emerged as the spin master on 1MDB.

Bandar Malaysia agreement with IWH CREC has lapsed.

The Ministry of Finance (MOF) cancelled it due to IWH CREC’s failure to meet the payment obligations outlined in the conditions precedent under the share sale agreement (SSA).

Typically, however, Pakatan Harapan tried to spin some tales based on half-truths and lies to paint a bleak picture on Bandar Malaysia, the country’s investment climate and 1Malaysia Development Board (IMDB), and to a certain extent, tarnish the credibility of Prime Minister Najib Razak.

Pakatan Harapan spin masters, like Petaling Jaya Utara MP Tony Pua Kiam Wee, ably aided by fake news portal Sarawak Report headed by mercenary writer Clare Rewcastle Brown and international spin master-media WSJ, tried to twirl a bizarre claim that the Chinese government had disallowed the investment by China Railway Engineering Corp (M) Sdn Bhd (CREC).

But, the fact is, the Pakatan’s spins are from the truth.

Termination of contract

TRX City Sdn Bhd – which comes under MOF, has announced that the cancellation of the Bandar Malaysia development agreement with the consortium of Johor-based Iskandar Waterfront Holdings Sdn Bhd (IWH) and China Railway Engineering Corp (M) Sdn Bhd (CREC) because the contract had lapsed.

It has nothing to do with Beijing administration and definitely, there is no such thing as repayment of RM741 million in deposits paid by IWH-CREC, as alleged by Tony Pua, once claimed by DAP godfather Lim Kit Siang as an “economy expert”.

In its full statement released on Wednesday, TRX City made it clear that despite repeated extensions being granted, IWH CREC failed to meet the payment obligations outlined in the SSA.

As a result, the share sale agreement between the parties stands null and void with immediate effect.

One does not need to be a rocket scientist to understand what are the meanings of “repeated extensions granted”, “failed to meet the payment obligations” and “null and void with immediate effect.”

The termination of the contract was purely a business decision, nothing to do with politics.

Shameful Pakatuans

But, of course, for Pakatan Harapan, everything is politics and must be politicised for selfish political interests at the expense of the national interests.

These Pakatan leaders, or Pakatuans, would even go abroad and overboard to smear the country and stop investors from coming to Malaysia.

And, they claim that they want to ‘Save Malaysia’.

A bunch of shameful Pakatuans indeed.

When a nation’s leader enters into collaborative partnerships with leaders of other nations, the agreements are typically monetary and negotiated as commitments.

These commitments are later translated into plans of action and subsequently into business contracts and deals, which normally are executed by members of the business delegation accompanying the leader.

Therefore, should any of the deals entered by members of a business delegation fall by the wayside, the setback cannot be construed as a collapse in a partnership agreement, or the backtracking of financial commitments by one nation on another.

It simply means a deal has collapsed, one that can be supplanted with a fresh business deal at a later date.

The cancelled Bandar Malaysia agreement was originally signed when 1MDB was embroiled in controversy.

Now with its cancellation and with 1MDB re-emerging as a progressive business entity, MOF decision to terminate the agreement with IWH CREC could be a blessing in disguise.

MOF may strike a better deal and better value for Bandar Malaysia, which will further reinvigorate the country’s fast-improving economy prospects.

Tony Pua

Did Tony Pua become the Petaling Jaya Utara MP for past two terms just to spin lies, half-truths, spread disinformation to mislead the people and incite hatred against the federal government?

If it is so, then he had failed in his statutory and constitutional duties to protect the nation’s interests.

Remember that Tony Pua had been a member of the parliamentary accounts committee (PAC) since 2008.

He has even boasted last October that his attendance record was unparalleled by any PAC member, except that of the committee chairman.

PAC carried out a comprehensive investigation on 1MDB, its dealings and finances during the height of a malicious campaign hatched and propagated by Mahathir Mohamad-led anti-Najib conspiracy (ANC).

And, Tony Pua, who boasted the highest attendance record among ordinary PAC members, have sat in these meetings to scrutinise the 1MDB.

He had all resources to check every detail of 1MDB’s business and financial dealings.

Reminder: Tony Pua has taken the oath as a parliamentarian to uphold the Federal Constitution, nation’s secrets and country’s interests.

Based on the doctrine of three main organs of the government, four in Malaysia as the country was based on a constitutional monarchy system, being an opposition MP, Tony Pua is actually an extended component of His Majesty government.

Which means, he must always act in the interest of the nation, period.

He is a PAC member, someone who can scrutinise 1MDB documents.

Therefore, how could Tony Pua perform media stunts regularly to criticise 1MDB when he was the investigator?

He seems did not know his constitutional role, the meaning of conflict of interests and the definition of confidentiality.

Whatever reservations, questions or views he had on 1MDB should be raised in PAC meetings, not to the public.

If he disagreed with PAC findings and decisions, then he should have resigned from the committee, and perhaps organise his long overdue debate with Arul Kanda.

He should not have signed on the PAC report on 1MDB if he disagreed with its findings, and even if he had signed, he could have easily penned it “under protest.”

He did nothing of that sorts but after the report was out, he painted the town red as if the report was faulty and manipulative.

When Tony Pua signed the report to give his approval, it means he had fully agreed with the committee’s findings on 1MDB.

It means, Tony Pua has conceded that Najib was not to be blamed for the 1MDB problem and if there was someone to be blamed, it should be the board of directors – to quote PAC deputy chairman, Kepong MP Tan Seng Giaw of DAP.

Which also means Tony Pua had admitted that he was guilty of spreading lies about 1MDB and on PM Najib.

Contempt of Parliament

Remember that the last time Tony Pua chickened out from a proposed debate with Arul Kanda by giving a lame excuse that he did not want to resign from PAC due to fear that its report on 1MDB would be manipulated without him.

In other words, Tony Pua was saying that “mirror, mirror, I am smartest of them all” to stop any manipulation in PAC-1MDB report.

The report was out with Tony Pua’s consent, right? Or was it not!

It means the report was not defective neither devious because the “smartest of them all” Tony Pua was there to see it all and finally approve it.

But he continues to spin 1MDB tales even after he had collectively approved the PAC report.

He has surely brought disrepute to his parliamentary position and committed a contempt of the Parliament.

What Tony Pua had done was not only unconstitutional.

He has also compromised PAC’s credibility and integrity and mocked the doctrine of separation of powers.

Through his unparliamentary-like acts, he had brought disrepute to his position as a member of Parliament and misused his parliamentary position.

It’s not an overstatement to suggest that Tony Pua had actually abused the public fund as his parliamentary wages were paid with taxpayers’ money.

Tony Pua is paid by the people to represent them in a correct rightful way – to uphold parliamentary integrity and dignity, and nation’s interest.

He is not being paid to manipulate, carry out publicity stunts and politicking, and spread falsehoods.

Tony Pua’s misconduct as a PAC member has not only had embarrassed himself but also insulted the intelligence of the right thinking people.

TRX City full statement

TRX City Sdn Bhd would like to announce that the share sale agreement (SSA) entered into on December 31, 2015 with Iskandar Waterfront Holdings Sdn Bhd (IWH) and China Railway Engineering Corp (M) Sdn Bhd (CREC) – which on July 21, 2016 assigned its benefits and responsibilities to IWH CREC Sdn Bhd – regarding the sale of 60% of the issued and paid-up capital of Bandar Malaysia Sdn Bhd, has lapsed.

This is because, despite repeated extensions being granted, IWH CREC failed to meet the payment obligations outlined in the Conditions Precedent under the SSA.

As a result, the share sale agreement between the parties stands null and void with immediate effect.

Looking ahead, given a significant appreciation in the value of the Bandar Malaysia land, TRX City’s sole shareholder the Ministry of Finance will now be retaining a 100% ownership of the site to ensure that the Malaysian people benefit from its development in its entirety.

TRX City will immediately be inviting expressions of interest for the role of master developer of Bandar Malaysia, with full ownership being preserved by the Ministry of Finance.

The selection process will involve very strict criteria, including track record, the speed of delivery and financial capability for such large-scale development.

This is to enhance all aspects of Bandar Malaysia, including its role as a business, transport, residential and tourism hub.

The steps taken today will ensure that there is no detrimental impact on the long-term development of Bandar Malaysia and that, upon its completion, the site will serve the national interest to an even greater extent than before.

Bandar Malaysia will be a catalyst for economic growth and national development.

The biggest development site in Malaysia in a key strategic position, it will offer many businesses, investment and employment opportunities, including Kuala Lumpur Internet City, the hub for the new Digital Free Trade Zone.

It will also be Malaysia’s transport nucleus, connecting the Kuala Lumpur-Singapore high-speed rail, MRT lines, KTM Komuter, Express Rail Link and 12 highways.
